Terms of Service

1. Acceptance of Terms

By engaging Flashsites Africa ("we", "our", or "us") for website development, hosting, maintenance, digital marketing, or related services, you agree to be bound by these Terms of Service.

2. Services

Flashsites Africa provides services including but not limited to:

• Website design and development
• Website hosting and maintenance
• Search Engine Optimization (SEO)
• Google Business Profile optimization
• Digital marketing services
• Content creation and management
• Website support and updates

The scope of work for each project will be agreed upon in writing before work begins.

3. Client Responsibilities

The client agrees to:

• Provide accurate information and required content
• Respond to requests for feedback and approvals in a timely manner
• Ensure all supplied content is owned by the client or properly licensed
• Pay all agreed fees according to the agreed payment schedule

4. Project Timelines

Project timelines are estimates and depend on the client providing required content, approvals, and feedback.

Delays caused by the client may result in adjusted delivery dates.

5. Payment Terms

• A 50% deposit is required before work commences unless otherwise agreed.
• The remaining balance is due before website launch or project delivery.
• Monthly services are billed in advance and payable according to the agreed package.
• All prices are quoted in South African Rand (ZAR) unless otherwise stated.

6. Hosting and Maintenance

Where Flashsites Africa provides hosting, maintenance, or ongoing support services:

• Monthly fees must be paid by the agreed due date.
• Failure to pay may result in suspension of services after reasonable notice.
• Flashsites Africa reserves the right to suspend hosting or maintenance services for overdue accounts.

7. Revisions and Scope Changes

Reasonable revisions are included as agreed in the project scope.

Requests that significantly change the agreed scope may require additional fees and revised timelines.

8. Intellectual Property

Upon full payment:

• The client owns the final website content and approved design elements created specifically for the project.
• Third-party software, plugins, templates, and services remain subject to their own licensing terms.

Flashsites Africa may showcase completed work in its portfolio unless otherwise agreed in writing.

9. Domain Names

Where Flashsites Africa registers a domain on behalf of a client:

• Ownership of the domain remains with the client once all applicable fees have been paid.
• Flashsites Africa may manage domain settings and renewals on the client's behalf.

10. Marketing and SEO Disclaimer

Flashsites Africa will use commercially reasonable efforts to improve digital visibility and performance.

However, we do not guarantee:

• Specific search engine rankings
• Website traffic volumes
• Lead volumes
• Sales or revenue increases

Results depend on market conditions and factors outside our control.

11. Limitation of Liability

To the fullest extent permitted by law, Flashsites Africa's total liability shall not exceed the amount paid by the client for the relevant services.

We shall not be liable for indirect, incidental, special, or consequential damages.

12. Termination

Either party may terminate ongoing services with written notice.

The client remains responsible for payment of services rendered up to the termination date.

Deposits are non-refundable once work has commenced.

13. Governing Law

These Terms shall be governed by the laws of the Republic of South Africa.
